1. Who we are and scope
This Privacy Policy explains how Seen Memories, a company incorporated in the Hashemite Kingdom of Jordan ("we", "us", "our"), collects, uses, shares, stores, and protects personal data when you visit www.seenmemories.com (the "Site") or use our mobile applications and related services (together, the "Services"). This Policy is part of our Terms of Service.
2. Governing law
We process personal data in accordance with the laws of the Hashemite Kingdom of Jordan, including the Jordan Personal Data Protection Law No. 24 of 2023 ("PDPL") and applicable regulations.
3. One-time consent and other lawful bases
By creating an account and/or agreeing to our Terms of Service, you provide explicit consent under the PDPL for the processing, storage, and transfer of your personal data for the purposes stated in this Policy and our Terms. This consent covers processing that is reasonably necessary for, or compatible with, providing, maintaining, securing, and improving the Services. We do not seek new consent for each compatible activity.
We may also process personal data without consent where permitted by the PDPL (e.g., legal obligations or court orders; protection of life or vital interests; public interest; prevention/detection of crime by competent authorities; performance of a contract; research/statistics with safeguards; or where the data is publicly available).
4. Categories of personal data we collect
(a) Identity & contact data: name, email, mobile number, delivery address.
(b) Account data: username, password, preferences, settings.
(c) Order & payment data: products ordered, delivery details, billing address, payment token/last four via our payment processor (we do not store full card numbers).
(d) Photo & media content: photos/images, captions and related metadata you upload to create photo products.
(e) Device/technical data: IP address, device identifiers, app version, logs, diagnostic/performance data.
(f) Usage data: pages/screens viewed, actions taken, timestamps, referring URLs.
(g) Marketing preferences: opt-in/opt-out status.
(h) Communications: messages you send to support or through in-app features.
5. Sources of personal data
We collect data (a) directly from you; (b) automatically from your device/browser/app; (c) from third-party services you choose to connect (e.g., Apple Photos, Google Photos, Facebook/Instagram, subject to their terms and your settings); and (d) from service providers acting on our behalf.
6. Purposes of processing
We process personal data to:
(a) register and authenticate accounts;
(b) create, produce, and fulfill photo products (printing, finishing, packaging, delivery);
(c) produce your photo products via our contracted printing and fulfilment processors acting on our instructions;
(d) process payments and prevent fraud/abuse;
(e) provide support and communicate about orders and the Services;
(f) operate, maintain, secure, and improve the Services (including analytics and diagnostics);
(g) enforce our Terms and protect our rights, users, and the public;
(h) comply with applicable law and lawful requests by competent authorities; and
(i) send direct marketing only where you have opted in (see Section 10).
7. Retention
We retain personal data only for as long as necessary to fulfill the purposes above or as required by law. When retention is no longer required, we delete or anonymize the data in accordance with the PDPL.
8. Cross-border transfers
Where necessary (e.g., cloud hosting, content delivery networks, payments, customer-support tools), we may transfer personal data outside Jordan. Transfers will comply with the PDPL and only be made either to recipients that provide protection not less than the PDPL or under a permitted legal exception (including explicit informed consent, public health, medical necessity, banking/transfer operations, judicial or law-enforcement cooperation). We maintain required records of such transfers.
9. Security and breach notification
We implement technical and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure, or loss. If a data incident creates a serious risk of harm, we will notify the competent PDPL unit within 72 hours and affected individuals within 24 hours of discovery, as required by law.
10. Marketing communications
We send direct marketing (email/SMS/push) only if you opt in. You may opt out at any time via the unsubscribe link or in-app settings. Service and transactional communications are not marketing and you may still receive them.
11. Cookies and similar technologies
We use cookies, SDKs, and similar technologies to operate the Services, keep you signed in, remember preferences, measure performance, and detect fraud. You can manage cookies in your browser/app settings; disabling certain cookies may affect functionality. Where required by law, we request consent for non-essential cookies.
12. Sharing and disclosure
We do not sell personal data. We may share personal data with:
(a) Service providers/contractors (processors) supporting printing/production, hosting/cloud storage, payments, delivery, analytics, customer support, security, and communications—bound to process only on our instructions and to protect the data.
(b) Printing & fulfilment providers (processors): We send photos and necessary order data to contracted third-party printers, finishers, packers and couriers acting solely as our processors to produce and deliver your orders. They may not use the data for their own purposes and must protect it, follow our documented instructions, and delete/return it after completion.
(c) Professional advisers (lawyers, auditors), and competent authorities/courts where legally necessary.
(d) Corporate transactions: in connection with a merger, acquisition, or asset transfer, subject to continued protection consistent with this Policy.
(e) With your direction or consent (e.g., when you use sharing features).
13. User content and photos of persons
You are responsible for the content you upload and for obtaining any required permissions under applicable law for images that include other individuals. We use your photos solely to provide the Services (e.g., layout, color correction, printing, delivery) and to operate/improve the Services as described here. We do not publicly display your content unless you choose a feature that expressly publishes or shares it.
14. Minors and legal capacity
If you are under 18, you may only use the Services with parental/guardian permission and supervision, consistent with our Terms. If we become aware that personal data was collected from a person lacking legal capacity without the required consent, we will take steps to delete it.
15. Your rights under the PDPL (summary)
Subject to the PDPL, you may have rights including access, obtaining a copy, correction, deletion, restriction, objection, withdrawal of consent, portability, and breach notification. Requests may be submitted to support@seenmemories.com. We will respond as required by Jordanian law. Nothing in this Policy creates obligations beyond those required by the PDPL.
16. Roles and responsibility under the PDPL
Seen Memories acts as the "responsible" party for processing personal data in connection with the Services. Where required (e.g., sensitive data, minors' data, financial data, or cross-border database transfers), we may appoint a data protection monitor. Contact (if appointed): info@seenmemories.com.
17. Payments
Payments are processed by third-party payment processors. We receive limited payment information (e.g., payment confirmation, last four digits, token) and do not store full card numbers. Processors handle payment details under their security standards and applicable law.
18. Third-party links and integrations
If you follow links to third-party sites/apps or connect third-party services (e.g., photo sources), their terms and privacy practices apply. We are not responsible for third-party privacy or security practices.
19. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will provide notice (e.g., by email, in-app, or on the Site) and indicate the effective date. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
